A non-profit organization (abbreviated as NPO, also known as a not-for-profit organization[1]) is an organization that does not distribute its surplus funds to owners or shareholders, but instead uses them to help pursue its goals.[2]
Examples of NPOs include charities (i.e. charitable organizations), trade unions and public arts organizations.
A non-profit is a business organization that serves some public purpose and therefore enjoys special treatment under the law. Nonprofit corporations, contrary to their name, can make a profit but can’t be designed primarily for profit-making.
The IRS points out that while most federal tax-exempt organizations are nonprofit organizations, organizing as a nonprofit at the state level doesn’t automatically grant you an exemption from federal income tax.
Nonprofits are incorporated under the laws of the state in which they are established. To receive federal tax-exempt status, the organization must apply with the IRS.
In this post 911 era non-profits have come under closer scrutiny by both state and the Federal government, especially regarding compliance with local and federal laws.
Many non-profits continue to operate with a “business as usual” attitude, which can lead to disaster when audited or reviewed for new or continuing funding; whether private or public.
Furthermore, in these recessionary times, charitable giving has declined. Many of the traditional sources of foundation and public funding have had to cut back, leaving many non-profits scrambling to meet their financial needs.
